This Terms of Service Agreement (the "Agreement") governs your use of this website, www.traveoholidays.com (the "Website"), Traveo Holidays ( "Business Name" ) offer of membership/services for purchase on this Website, or your purchase of membership/services available on this Website. This Agreement includes, and incorporates by this reference, the policies and guidelines referenced below. Traveo Holidays reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website. Traveo Holidays will alert you that changes or revisions have been made by indicating on the top of this Agreement the date it was last revised. The changed or revised Agreement will be effective immediately after it is posted on this Website. Your use of the Website following the posting any such changes or of a revised Agreement will constitute your acceptance of any such changes or revisions. Traveo Holidays encourages you to review this Agreement whenever you visit the Website to make sure that you understand the terms and conditions governing use of the Website. This Agreement does not alter in any way the terms or conditions of any other written agreement you may have with Traveo Holidays for other membership or services. If you do not agree to this Agreement (including any referenced policies or guidelines), please immediately terminate your use of the Website. I. Membership

1. Traveo Holidays Pvt Ltd, a company incorporated under the companies act 2013, is engaged in travel and tourism. The sole purpose of the company is to negotiate for best price on behalf of its customers. 

2. Traveo membership provides privilege access to book unlimited holidays at discounted prices. The member must be at-least 18 years of age. 

3. Your Membership will be activated after successful payment confirmation from the Bank.

4. Membership is a one-time non refundable fee and there are no extra charges.

5. The online receipt will be sent along with the Welcome letter. We strongly recommend you to review the Membership particulars, Terms and procedures for booking your holidays before availing the membership.

6. All the Traveo associates are separate entities who have partnered with Traveo Holidays Pvt Ltd. The associate list would be updated without prior intimation.

7. Refund and cancellation policy: Customers can cancel the membership within 10days of purchase with 100% refund. Applicable charges for introductory offers availed will be deducted for cancellation within 10 days.

8. All the offers mentioned are subject to availability.

9. You can avail the membership after accepting these Terms and Conditions.

Membership Particulars

1. Beginner

The membership is valid for 5 years which is non amendable. Traveo members can book unlimited holidays at discounted prices throughout the membership period. Members get privilege access to discounts and offers negotiated by Traveo Holidays. The membership also offers discounts to International room bookings, International and domestic tour package bookings.

2. Pro

The membership is valid for 10 years which is non amendable. There is a grace period of 1 year wherein the membership will be active only after the first booking. Traveo members can book unlimited holidays at discounted prices throughout the membership period. Members get privilege access to discounts and offers negotiated by Traveo Holidays. The membership also offers discounts to International room bookings, International and domestic tour package bookings. Travel rewards are offered for the number of package bookings done in a year.

3. Pro Plus

The membership is valid for 10 years which is non amendable. There is a grace period of 1 year wherein the membership will be active only after the first booking. There is introductory free holiday with the membership. There is a time limit for availing the free holiday which will be mentioned in the offers document.  Traveo members can book unlimited holidays at discounted prices throughout the membership period. Members get privilege access to discounts and offers negotiated by Traveo Holidays. The membership also offers discounts to International room bookings, International and domestic tour package bookings. Travel rewards are offered for the number of package bookings done in a year.

4. Ultimate

The membership is valid for 20 years which is non amendable. There is a grace period of 1 year wherein the membership will be active only after the first booking. There is introductory free holiday with the membership. There is a time limit for availing the free holiday which will be mentioned in the offers document.  Traveo members can book unlimited holidays at discounted prices throughout the membership period. Members get privilege access to discounts and offers negotiated by Traveo Holidays. Ultimate membership also offers privilege access to International and domestic tour package bookings. There will be a dedicated relationship management team who will personalize the package according to the member needs. There is a Bucket-list of places and activities at discounted prices which will be frequently notified to the member.  Travel rewards are offered for the number of package bookings done in a year.

Note: The discounts offered by Traveo Holidays are prices offered by the resorts and other service providers which will be subject to availability. Traveo Holidays will act as your travel partner who will negotiate for best prices. However, Traveo Holidays will have no say in the pricing of any resorts or services.Pandemic times or any other unexpected emergency times will be waived off from the membership period.

II. Website

Content; Intellectual Property; Third Party Links. 

In addition to making Membership available, this Website also offers information and marketing materials. This Website also offers information, both directly and through indirect links to third-party websites, about resorts/hotels room booking and tour packages. Traveo Holidays does not always create the information offered on this Website; instead the information is often gathered from other sources. To the extent that Traveo Holidays does create the content on this Website, such content is protected by intellectual property laws of the India, foreign nations, and international bodies. Unauthorized use of the material may violate copyright, trademark, and/or other laws. You acknowledge that your use of the content on this Website is for personal, non-commercial use. Any links to third-party websites are provided solely as a convenience to you. Traveo Holidays does not endorse the contents on any such third-party websites. Traveo Holidays is not responsible for the content of or any damage that may result from your access to or reliance on these third-party websites. If you link to third-party websites, you do so at your own risk. 

Use of Website

Traveo Holidays is not responsible for any damages resulting from use of this website by anyone. You will not use the Website for illegal purposes. You will (1) abide by all applicable local, state, national, and international laws and regulations in your use of the Website (including laws regarding intellectual property), (2) not interfere with or disrupt the use and enjoyment of the Website by other users, (3) not resell material on the Website, (4) not engage, directly or indirectly, in transmission of "spam", chain letters, junk mail or any other type of unsolicited communication, and (5) not defame, harass, abuse, or disrupt other users of the Website

License

By using this Website, you are granted a limited, non-exclusive, non-transferable right to use the content and materials on the Website in connection with your normal, noncommercial, use of the Website. You may not copy, reproduce, transmit, distribute, or create derivative works of such content or information without express written authorization from Traveo Holidays or the applicable third party (if third party content is at issue).

Terms of Room Booking and other services offered
 

I. The terms and conditions mentioned are applicable to all the services offered by TRAVEO HOLIDAYS PVT LTD with the selected plan. Room bookings, Package bookings, and all other services offered are included in this agreement.

II. The booking voucher will be issued to the customer subject to providing copy of ID proof, Address proof, and compliance of the KYC norms of the whole travelers. The customer must be at least 18 years of age.

III. TRAVEO HOLIDAYS PVT LTD has the right to add or withdraw any associated properties or tour packages from the list that has given in the website at any time without prior intimation. Booking is through website or through phone. Bookings will be confirmed subject to availability of the rooms. At the time of booking if any resort/hotel dates are not available, the customers should try to book an alternate available dates or resorts.

IV. Booking is to be done through Traveo Holidays website or by email info@traveoholidays.com or through TRAVEO HOLIDAYS PVT LTD phone number after customer verification. The booking is only confirmed once the booking voucher is issued. The reservation merely with an email confirmation without a booking voucher is not a confirmed booking and therefore the same will not be accepted. Peak time room bookings will also be subject to room availability.

V. There can be exceptional circumstances where TRAVEO HOLIDAYS PVT LTD or the Service Providers may be unable to honor the confirmed bookings due to various reasons like act of God, a pandemic, an epidemic, government decisions, terrorist activity, business exigencies any operational and technical issues, or any other reason beyond the control of TRAVEO HOLIDAYS PVT LTD. If TRAVEO HOLIDAYS PVT LTD has advance knowledge of any such situations where dishonor of bookings may happen, we will make best efforts to provide similar alternatives to the Customer or refund the booking amount after deducting applicable service charges. The Customer agrees that TRAVEO HOLIDAYS PVT LTD being merely a facilitator of the products and services offered, cannot be held responsible for any such Force Majeure circumstance.

VI. Right to cancel the bookings: The Customer expressly undertakes to provide TRAVEO HOLIDAYS PVT LTD with correct and valid information while making use of this customer agreement, and not to make any misrepresentation of facts. Any default on part of the customer would disentitle the customer from availing the services.

In case TRAVEO HOLIDAYS PVT LTD discovers or has reasons to believe at any time during or after receiving a request for services from the Customer that the request for services is either unauthorized or the information provided by the Customer or any of the travelers is not correct or that any fact has been misrepresented by that Customer, TRAVEO HOLIDAYS PVT LTD shall be entitled to appropriate legal remedies against the Customer, including cancellation of the bookings, without any prior intimation to the Customer. In such an event, TRAVEO HOLIDAYS PVT LTD shall not be responsible or liable for any loss or damage that may be caused to the Customer or any other person in the booking, as a consequence of such cancellation of booking or services.

If any judicial, quasi-judicial, investigation agency, government authority approaches TRAVEO HOLIDAYS PVT LTD to cancel any booking, TRAVEO HOLIDAYS PVT LTD will cancel the same without approaching the concerned Customer whose booking has been cancelled.

The Customer shall not hold TRAVEO HOLIDAYS PVT LTD responsible for any loss or damage arising out of measures taken by TRAVEO HOLIDAYS PVT LTD for safeguarding its own interest and that of its genuine customers. This would also include TRAVEO HOLIDAYS PVT LTD denying or cancelling any bookings on account of suspected fraud.

ROLE AND LIMITATION OF LIABILITY OF TRAVEO HOLIDAYS PVT LTD
 

TRAVEO HOLIDAYS PVT LTD acts as a Travel agent and merely provides a platform to the Customer to select and book a particular hotel/resort/package/transport. Hotels in this context includes all categories of accommodations such as hotels, home-stays, bed and breakfast stays, farm-houses, house-boats  and any other alternate accommodations. Transport in this context includes all types of transport such as flights/taxi/bus/boat or any alternate transport.

All the information pertaining to the hotel/package including the category of the hotel, images, room type, activities, meal plan, amenities and facilities available at the hotel are as per the information provided by the hotel/service agent to TRAVEO HOLIDAYS PVT LTD. This information is for reference only. Any discrepancy that may exist between the website/brochure/shared pictures and actual settings of the hotel/package/meal plan shall be raised by the Customer with the hotel/service agent directly, and shall be resolved between the Customer and hotel/service agent. TRAVEO HOLIDAYS PVT LTD will have no responsibility in that process of resolution, and shall not take any liability for such discrepancies.

INFORMATION FROM THE HOTEL AND THE TERMS OF THE HOTEL
 

The hotel booking voucher which TRAVEO HOLIDAYS PVT LTD issues to a Customer is solely based on the information provided or updated by the hotel regarding the inventory availability. In no circumstances can TRAVEO HOLIDAYS PVT LTD be held liable for failure on part of a hotel to accommodate the Customer with a confirmed booking, the standard of service or any insufficiency in the services, or any other service-related issues at the hotel. The liability of TRAVEO HOLIDAYS PVT LTD in case of denial of check-in by a hotel for any reason what-so-ever including over-booking, system or technical errors, or unavailability of rooms etc., will be limited to either providing a similar alternate accommodation at the discretion of TRAVEO HOLIDAYS PVT LTD (subject to availability at that time), or refunding the booking amount (to the extent paid) to the Customer. Any other service-related issues should be directly resolved by the Customer with the hotel.
Hotels reserves the sole right of admission and TRAVEO HOLIDAYS PVT LTD has no say whatsoever in admission or denial for admission by the hotel. Unmarried or unrelated couples may not be allowed to check-in by some hotels as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at the time check-in. Some hotels may also not allow local residents to check-in as guests. TRAVEO HOLIDAYS PVT LTD will not be responsible for any check-in denied by the hotel due to the aforesaid reasons or any other reason not under the control of TRAVEO HOLIDAYS PVT LTD.
No refund would be applicable in case the hotel denies check-in under such circumstances.
 

REFUND AND CANCELLATION POLICY WILL BE ACCORDING TO THE HOTELS/RESORTS POLICY. PLEASE REVIEW THE SAME AT THE TIME OF BOOKING.  

RESPONSIBILITIES OF THE CUSTOMER
 

The Customer would be liable to make good any damage(s) caused by any act of him/ her/ or their accompanying guests (willful/negligent) to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. TRAVEO HOLIDAYS PVT LTD would not, in any way, intervene in the same.

The Customer has to be in possession of a valid identity proof and address proof, at the time of check-in. The hotel shall be within its rights to deny check-in to a Customer if a valid identity proof is not presented at the time of check-in.

Check-in time, check-out time, and any changes in those timings, will be as per hotel policy & terms. Early check-in or late check-out request is subject to availability and the hotel may charge an additional fee for providing such services.
 

ADDITIONAL CHARGES BY THE HOTEL/RESORT
 

The booking amount paid by the Customer is only for stay at the hotel. Some bookings may include breakfast and/ or meals as confirmed at the time of booking. Any other services utilized by the Customer at the hotel, including laundry, room service, internet, telephone, extra food, drinks, beverages etc. shall be paid by the Customer directly to the hotel.

BY PAYING THE AMOUNT FOR THE BOOKING YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.
 

III. DISLAIMER OF WARRANTIES

YOUR USE OF THIS MEMBERSHIP/SERVICES ARE AT YOUR SOLE RISK. THE MEMBERSHIP/SERVICES ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TRAVEO HOLIDAYS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT WITH RESPECT TO THE MEMBERSHIP, OR ANY RELIANCE UPON OR USE OF THE MEMBERSHIP/SERVICES.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, TRAVEO HOLIDAYS MAKES NO WARRANTY:

THAT THE INFORMATION PROVIDED ON THE WEBSITE OR ANY OTHER MARKETING MATERIAL IS ACCURATE, RELIABLE, COMPLETE, OR TIMELY.

THAT THE INFORMATION ABOUT THIRD-PARTY SERVICES IS ACCURATE, RELIABLE, COMPLETE, OR TIMELY.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THIS AGREEMENT, WEBSITE OR ANY OTHER MARKETING MATERIAL WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE MEMBERSHIP OR SERVICES OR THAT DEFECTS IN MEMBERSHIP OR SERVICES WILL BE CORRECTED.

REGARDING ANY MEMBERSHIP PURCHASED AND SERVICES AVAILED; DIRECTLY OR THROUGH THE WEBSITE.

IV. INDEMNIFICATION

You will release, indemnify, defend and hold harmless Traveo Holidays, and any of its contractors, agents, employees, officers, directors, shareholders, affiliates and assigns from all liabilities, claims, damages, costs and expenses, including reasonable attorneys' fees and expenses, of third parties relating to or arising out of (1) this Agreement or the breach of your warranties, representations and obligations under this Agreement; (2) the Website content or your use of the Website content; (3) the Membership/Services or your use of the Membership/Services (4) any intellectual property or other proprietary right of any person or entity; (5) your violation of any provision of this Agreement; or (6) any information or data you supplied to Traveo Holidays. When Traveo Holidays is threatened with suit or sued by a third party, Traveo Holidays may seek written assurances from you concerning your promise to indemnify Traveo Holidays; your failure to provide such assurances may be considered by Traveo Holidays to be a material breach of this Agreement. Traveo Holidays will have the right to participate in any defence by you of a third-party claim related to your use of any of the Website content or Membership/Services, with counsel of Traveo Holidays choice at its expense. Traveo Holidays will reasonably cooperate in any defence by you of a third-party claim at your request and expense. You will have sole responsibility to defend Traveo Holidays against any claim, but you must receive Traveo Holidays prior written consent regarding any related settlement. The terms of this provision will survive any termination or cancellation of this Agreement or your use of the Website or Membership/Services.

V. GENERAL

Force Majeure

Traveo Holidays will not be deemed in default hereunder or held responsible for any cessation, interruption or delay in the performance of its obligations hereunder due to anyunforeseen events like, earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, any pandemic situation due to the outburst of any spreadable disease/virus, labor strike, lockout, or boycott or any other situation beyond the control of Traveo Holidays.

Cessation of Operation

Traveo Holidays may at any time, in its sole discretion and without advance notice to you, cease operation of the Website and distribution of the Membership/Services.

Entire Agreement

This Agreement comprises the entire agreement between you and Traveo Holidays and supersedes any prior agreements pertaining to the subject matter contained herein.

Effect of Waiver

The failure of Traveo Holidays to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

ARBITRATION CLAUSE

Any claim, dispute or difference relating to or arising out of this Agreement shall be referred to the arbitration, of a sole arbitrator. The arbitration shall be subject to the Arbitration and Conciliation Act, 1996 as may be amended from time to time. The Arbitrator will conduct the Arbitration in accordance with its rules for conduct of Arbitration proceedings then in force and applicable to the proceeding. The seat and venue of arbitration shall be Cochin. The proceedings shall be undertaken in English. The arbitration award shall be final and binding on the parties.”

JURISDICTION AND GOVERNING LAW

All disputes arising out of and/or relating to this Membership Agreement shall be subject to the exclusive jurisdiction of competent courts at Cochin, India.

This Agreement shall be governed by the law of India.

Statute of Limitation

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or Membership/Services or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Waiver of Class Action Rights

BY ENTERING INTO THIS AGREEMENT, YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT YOU MAY HAVE TO JOIN CLAIMS WITH THOSE OF OTHER IN THE FORM OF A CLASS ACTION OR SIMILAR PROCEDURAL DEVICE. ANY CLAIMS ARISING OUT OF, RELATING TO, OR CONNECTION WITH THIS AGREEMENT MUST BE ASSERTED INDIVIDUALLY.

Termination

Traveo Holidays reserves the right to terminate your access to the website/membership/services if it reasonably believes, in its sole discretion, that you have breached any of the terms and conditions of this Agreement. Following termination, you will not be permitted to use the website/membership/services and Traveo Holidays may, in its sole discretion and without advance notice to you, cancel any outstanding orders for Membership/Services. If your access to the Website is terminated, Traveo Holidays reserves the right to exercise whatever means it deems necessary to prevent unauthorized access of the Website. This Agreement will survive indefinitely unless and until Traveo Holidays chooses, in its sole discretion and without advance to you, to terminate it.

Domestic Use

Traveo Holidays makes no representation that the Website or Membership/Services are appropriate or available for use in locations outside India.

Assignment

You may not assign your rights and obligations under this Agreement to anyone. Traveo Holidays may assign its rights and obligations under this Agreement in its sole discretion and without advance notice to you.

BY USING THIS WEBSITE OR AVAILING MEMBERSHIP/SERVICES FROM THIS WEBSITE YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.
